The Former Prime Minister of Pakistan as well as the Chief of the Pakistan Tehreek-e-Insaf, Imran Khan has filed an application through his counsel Sardar Latif Khan Khosa for transferring of his case before Islamabad High Court.
It is to be noted that, the application for transfer of cases has been filed after former PM Khan expresses deep loss of faith in the IHC Chief Justice Aamer Farooq’s court. He wanted IHC to “recuse himself” from all the benches hearing cases against him.
As per the petition, Justice Farooq hears almost all cases against him. It said Justice Farooq validated Khan’s arrest on May 9, and later endorsed his jail trial. It alleged the chief justice has made a delay in disposing of the petition against Khan’s disqualification in the Toshakhana case, which led to the filing of a complaint by the ECP before a session judge.
Subsequently, the trial court convicted Khan in the case in a hasty manner. The petition further levelled allegations that the IHC chief justice removed the incomplete judgement in the Tyrian White case from the website, held back the release of the majority judgement and issued press release via the registrar, making claims that the bench had already been dissolved and the matter would be heard afresh.
Former PM Khan had earlier moved same petition before the high court asking for the transfer of his cases from the court of the chief justice for allegedly having ‘deep and settled bias’, through IHC record shows Justice Farooq granted relief to Khan in more than 35 of his 40 petitions since May.
Justice Farooq, on May 14, issued a stay order against the proceeding of the Toshakhana case, which was reversed in the month of July. He overruled the administrative objects which were raised by the registrar’s office to 16 petitions seeking transitory bail and granted him bail even for two times in the same FIRs. He granted bail to Khan in all these case against nominal surety bonds.
